Terms of Service

1. Acceptable Use

The Platform is a professional network for the creative industry. You agree to:

• Use the Platform only for lawful, professional purposes related to creative work, portfolio presentation, professional networking, and job opportunities.
• Maintain professional conduct in all interactions, including messaging threads and job applications.
• Not upload content that is illegal, defamatory, discriminatory, harassing, or otherwise objectionable.
• Not misrepresent your identity, qualifications, or professional experience.
• Not use automated tools, bots, or scrapers to access or collect data from the Platform without our express written permission.
• Not attempt to circumvent security measures, access controls, or the vetted admission process.

We reserve the right to remove content that violates these standards and to suspend or terminate accounts of users who repeatedly breach these guidelines.

2. Content Ownership

You retain full intellectual property rights over all content you upload to the Platform, including portfolio items, images, videos, documents, and written materials.

By uploading content to the Platform, you grant us a non-exclusive, worldwide, royalty-free licence to display, distribute, and make available your content as part of the Platform’s normal operation. This includes displaying your portfolio to other users, showing your profile in search results, and generating thumbnails or previews of your work.

This licence exists solely for the purpose of operating the Platform and terminates when you delete the content or your account. We will not sell, sublicence, or use your content for purposes unrelated to the Platform without your explicit consent.

3. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law:

• We make no warranties, express or implied, regarding the Platform’s reliability, accuracy, or fitness for a particular purpose.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claim arising from or related to the Platform shall not exceed the total amount you paid to us in the 12 months preceding the claim.
• We are not responsible for the conduct, content, or actions of other users on the Platform.
• We do not guarantee the outcome of any job application, hiring process, or professional engagement facilitated through the Platform.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

4. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

In the event of a dispute, we encourage you to contact us first at [email protected] to seek an informal resolution. If a dispute cannot be resolved informally within 30 days, either party may bring proceedings in the courts of England and Wales.

5. Subscriptions and Payments

Certain features of the Platform require a paid subscription. All payments are processed securely through Stripe.

• Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). Your subscription automatically renews unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until your current period expires.
• Refunds: We do not offer refunds for partial billing periods. If you believe you have been charged in error, please contact us within 14 days of the charge.
• Job posting fees: One-off job posting fees are non-refundable once the job has been published on the Platform.
• Price changes: We may change subscription prices with 30 days’ notice. Continued use of the Platform after a price change constitutes acceptance of the new price.

6. Account Termination

Termination by you: You may delete your account at any time through your account settings. Account deletion is an irreversible action. Upon deletion, we will remove your profile, portfolio items, application history, and associated data in accordance with our Privacy Policy. Some data may be retained where required by law.

Termination by us: We may suspend or terminate your account if you:

• Breach these Terms or our acceptable use policy.
• Engage in conduct that is harmful to other users, the Platform, or third parties.
• Provide false or misleading information during admission or profile creation.
• Fail to pay subscription fees or other charges when due.
• Are inactive for an extended period (we will notify you before taking action).

Where possible, we will provide notice and an opportunity to address the issue before terminating your account. In cases of serious or repeated violations, we may terminate immediately.

7. Vetted Admission Process

Indstry operates a curated admission process to maintain the quality and professionalism of our community. Access to the Platform is not automatic:

• Application: Prospective members apply through our early access or waitlist process. Applications are evaluated based on professional experience, portfolio quality, and relevance to the creative industry.
• Scoring: Applications receive a priority score based on objective criteria. Higher-scoring applications are processed first.
• Admin review: Final admission decisions are made by our team. We reserve the right to accept or decline any application at our sole discretion.
• No guarantee: Submitting an application does not guarantee admission. We are not obligated to provide reasons for declining an application.

We may change our admission criteria at any time without notice. This process exists to ensure the Platform remains a trusted, high-quality space for creative professionals.

8. AI Features Disclaimer

The Platform includes artificial intelligence features, including search matching, profile suggestions, and onboarding assistance. These features are provided on an advisory basis only:

• AI-generated suggestions, matches, and recommendations are not guaranteed to be accurate, complete, or suitable for your specific circumstances.
• You should independently verify any information or suggestions provided by AI features before relying on them.
• We do not guarantee the quality or relevance of search results, job matches, or profile recommendations generated by AI.
• AI processing of your data is subject to your consent and can be disabled at any time, as described in our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Platform at least 14 days before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
